ACCOMMODATION SERVICES DISTANCE SALES CONTRACT

1. Subject and Scope

The website www.cappadociacavesuiteshotel.com has been prepared and made available by Baybora Halıcılık Kuyumculuk ve Tur. San. ve Tic. Ltd. Şti., located at Gafferli Mahallesi, Ünlü Sokak No:19, Göreme, Nevşehir, which operates the hotel under the Cappadocia Cave Suites brand.

Cappadocia Cave Suites provides hotel reservation services via the Website in accordance with the terms and conditions set out in this Accommodation Services Distance Sales Contract.


2. Parties

This contract is made between Cappadocia Cave Suites on one side and the individual who completes the online reservation on the Website on the other side, who accepts the following terms and conditions in advance by entering and approving all requested personal information.

Services are offered only to individuals who are legally authorized to enter into binding contracts under applicable law.
The consumer using the services on the Website declares that:

  • they have the right, authority, and legal capacity to enter into contracts,

  • they can assume legal obligations regarding any liability arising from the use of the services,

  • they are over eighteen (18) years of age.

The consumer also undertakes that they are authorized to make a reservation for themselves, for any accompanying person(s), or for the person they represent.


3. Service Descriptions

The Website allows consumers to make accommodation reservations.

The Terms of Sale regulate the contractual relationship between the consumer and the hotel regarding the service provided.
By checking the Terms of Sale box, the consumer confirms that:

  • they have reviewed and accepted the terms and conditions in advance,

  • they have been informed about the website terms of use, hotel accommodation rules, reservation conditions, and applicable tariffs.

The Terms of Sale apply to reservations made for Cappadocia Cave Suites.

All images, descriptions, and content on the Website are for informational purposes only.

Despite every effort to accurately reflect the services provided, differences may occur—especially due to renovations, changes in furniture, or updates.
In case of doubt, consumers may contact the hotel using the contact details listed on the Website.
The hotel cannot be held liable for minor or non-material errors.

Information provided to consumers includes:

  • Basic features of the hotel and services

  • Applicable prices

  • Payment conditions

  • Terms of sale and contractual provisions

The consumer is solely responsible for choosing services suitable for their needs.
All reservations are personal and may not be transferred to third parties, either partially or in full.


4. Type of Accommodation

The accommodation concept and its details are available on the Website and/or on the social media accounts listed therein.

The consumer’s age and identity will be checked at check-in. The consumer is responsible for any expenses arising from incorrect information provided.

The consumer declares, accepts, and undertakes that:

  • regardless of arrival time, the earliest room check-in time is 14:00,

  • regardless of departure time, the latest room check-out time is 11:30,

  • any additional services requested after check-out will be charged separately.

Small-breed cats and dogs are accepted at the hotel.


5. Contract Duration

This contract enters into force on the date the reservation is confirmed by the hotel and automatically terminates when the consumer’s service period ends, provided no dispute arises.

In case of a dispute, the contract remains valid until the issue is fully resolved.


6. Reservation Procedures

All reservation information must be accurately filled in by the consumer.
The consumer must provide correct, complete, and accurate personal details when purchasing or reserving services through the Website.
Cappadocia Cave Suites bears no responsibility for incorrect or incomplete information entered by the consumer.

Before confirming the reservation, the consumer can access this contract and the payment information via hyperlink.
By checking the required boxes, the consumer confirms that they have reviewed and accepted the terms freely.

The hotel reserves the right to refuse or cancel reservations for legitimate reasons such as:

  • unusually high numbers of bookings,

  • previous disputes with the consumer.

Reservation Process Summary

  1. The consumer selects the hotel.

  2. The consumer selects check-in and check-out dates.

  3. The number of adults, infants, and/or children is entered.

  4. A suitable room type is selected.

  5. The consumer views a full reservation summary and can make changes.

  6. Payment method (credit card) is selected.

  7. The “Guest Information” form is filled (name, surname, email, country, phone number, special requests).

  8. The consumer checks:

    • “I have read and accept the Sales Conditions”

    • “I have read and accept the Terms and Conditions”

    • “I have read the Accommodation Services Information”

    • “I have read the Payment Information”

  9. The consumer clicks “Read & Make Reservation”.

  10. The hotel does not process any credit card information on the Website.

  11. The consumer is directed to a secure bank payment page.

  12. Payment is made via virtual POS.

Upon completing the reservation and payment, the consumer receives a detailed confirmation email.


7. Payment and Billing Information

Consumers must pay the full service fee during the reservation process when paying by credit card.
Prices include VAT.

The Website is SSL-encrypted.
The hotel does not process consumers’ credit card information.

During check-in, the consumer must present the credit card used for the reservation.
Third-party credit cards are not accepted.
Consumers who cannot present the card will be charged again and must pay the accommodation fee in advance.

The consumer is responsible for damages arising from failure to meet these obligations.

Invoices are given to the consumer at check-out.
If not received, the invoice is sent to the email or physical address provided.
Incorrect address or missing address information is the consumer’s responsibility.

According to the Tax Procedure Law, the invoice must be issued within seven (7) days of the service being provided (including check-out day), as long as the month is not exceeded.


8. Cancellation / Changes

Except for documented force majeure (death, accident, etc.):

  • Up to 14 days before check-in: full refund.

  • 14 days or less before check-in: no refund.

Refunds are made only to the card used for the reservation.

Bank processing times may vary.
Any refund transaction fees charged by the bank or payment provider are deducted from the refundable amount.

If the consumer cancels the stay after checking in for reasons other than the hotel’s failure to provide service, no refund will be issued.

These terms do not apply to:

  • promotional stays

  • early booking deals

  • discounted reservations
  • non-refundable reservations

For date changes requested by the consumer, cancellation conditions still apply.

The consumer agrees to follow all hotel service rules and respect the life, property, and peace of third parties. Failure to comply may result in removal from the hotel without a refund.


9. Personal Data

The consumer declares that they have been informed in accordance with Article 10 of the Turkish Personal Data Protection Law (Law No. 6698) through the Website and through acceptance of this contract.

Consumer rights under Article 11 of Law No. 6698, the data request process, and the privacy notice are always accessible on:

Cappadocia Cave Suites never requests passwords, usernames, credit card information, reservation details, or other personal data via e-mail.
Any such message is “phishing” and should not be responded to.


10. Force Majeure

Situations such as adverse weather, natural disasters, terrorism, military operations, social unrest, pandemics, epidemics, international incidents, technical failures, strikes, or lockouts occurring before or during the reservation period are considered force majeure.

In such cases, the hotel may:

  • discontinue service, or

  • relocate the guest to an equivalent hotel of the same standard.

The hotel cannot be held responsible for incomplete service or inability to provide service due to force majeure.


11. Other Provisions

The hotel may change the prices listed on the Website, and all prices are subject to availability.

Due to reasons beyond hotel control, the hotel reserves the right to change or replace any scheduled performer (for holiday programs, New Year’s events, etc.).

The hotel also reserves the right to:

  • choose dates for bringing performers,

  • decide not to bring performers.

The company may cancel or refuse any service or reservation if an error is detected on the Website regarding the listed services or prices.

If price information is incorrect due to errors, the company may cancel, refuse, or reject the service—even if payment has already been collected.

All services are subject to availability and may be changed or withdrawn at any time without notice.
Consumers cannot claim compensation or rights in such cases.

Cappadocia Cave Suites reserves the right to amend these terms at any time.
Updated terms will be published on the Website with their effective date.
Consumers are advised to review terms regularly.

The consumer is bound by the Sales Conditions in effect at the time of booking.


12. Dispute Resolution

This contract is governed by Turkish law.
Any disputes— including those related to validity or interpretation—shall be resolved by the Nevşehir Courts and Enforcement Offices.
